This technique can be done in different countries, as the United States, the United Kingdom or India.

n the case of the United States, there is a complex legal process behind the treatment, which ensures the delivery of the new born to the couple, who will legally be the parents. Legal certainty is very important in states like California.
Furthermore, they have a highly regulated treatment from the legal standpoint.
Some years ago, there was a motherhood claim by a mother who has gestated
the child, refusing to deliver him to the parents. The Supreme Court did not admit she was right and ruled that the real child’s parents were the couple. Since then, there have been no more motherhood claims from any surrogate mother (who otherwise, cannot achieve her purpose).
In the case of the United Kingdom, the legislation is even clearer and the process is much easier. The consent includes a section that textually reads, ‘I understand I will be the legal mother of the newborn only the time necessary to complete the legal process for the transference of the parental responsibilities to the commissioned woman’. This legal process is rather short and simple. An important difference between these two countries is that in the United States it is allowed to pay to the mother who is going to gestate the child (which makes the treatment more expensive), whereas in the United Kingdom any payment is forbidden. Once again, the intention of the Authority is to make the process altruist, devoid of any economical interest on the side of the woman who will gestate the child. This makes surrogate mothers to be rather frequent in California and quite rare in the United Kingdom. Most of the time, the surrogate mother in the United Kingdom is a relative or an acquaintance of the future mother.

What happens in other countries like Ukraine, Russia or India?
Briefly, lack of regulation and legal uncertainty. Surrogate motherhood is popularly known as ‘womb for rent’. With this technique, pregnancy is carried by a woman that finally is not the child’s legal mother.

It can be done with the legal mother’s own eggs or with eggs from a donor.
